The new Polish Citizenship Act

On April 2nd, 2009, the Lower House of the Polish parliament (Sejm) passed a new act on Polish citizenship which is to replace the Polish Citizenship Act of 1962. The Act will come into force on August 15th, 2012. The new Act regulations are to a great extent in accordance with the binding Polish Citizenship Act of 1962. However, the Act of 2009 introduces several new legal measures. The most important are:

  • introducing the possibility to reinstate Polish citizenship: it will be significant for former Polish citizens who have lost their Polish citizenship due to political reasons and now they would like to regain it,
  • introducing the possibility for foreigners to acquire Polish citizenship by recognition: after meeting certain requirements, a foreigner will be able to apply to the Polish authorities for being recognized as a Polish citizen. The new legal measure will make acquiring Polish citizenship much easier to foreigners.
