Loss of citizenship by the decision of Polish authorities

The possibility of depriving a Polish citizen of his/her Polish citizenship was present in the Polish Citizenship Act of 1951 and was also introduced into the new Polish Citizenship Act of 1962. According to Article 15 of the Polish Citizenship Act, a Polish citizen who has resided abroad could be deprived of Polish citizenship if he/she:

  • infringed the loyalty obligation to the Polish State,
  • acted to the detriment of the vital interests of the Polish State,
  • illegally left the Polish territory after May 9th, 1945,
  • refused to return to the Polish State after being summoned by the Polish authorities,
  • evaded military service,
  • was convicted abroad for a crime or was a recidivist.
