The application for a residence card for a family member of the EU citizen

The application for a residence card for a family member of the EU citizen shall be filed in the province office competent as for the place of residence of the EU citizen. For example, if the EU citizen lives in Kraków, then the application to register his family member’s residence shall be submitted in Małopolski Urząd Wojewódzki (the Malopolska Provincial Office).

The application for a residence card for a family member of the EU citizen must be attached with:

• a photocopy of the foreigner’s travel document (passport);

• a confirmation of a temporary registration in a given town;

• a certificate of registering the residence of the EU citizen, issued to the EU citizen with whom the family member stays in the territory of Poland;

• marriage certificate, if the applicant is the spouse of the EU citizen;

• a document confirming the existence of family bonds, if the applicant is a child or a grandchild of the EU citizen and the document confirming the age or the fact that the applicant is financially dependent on the EU citizen;

• a document confirming the existence of family bonds, if the applicant is one of the parents or grandparents of the EU citizen and the document confirming the fact that the applicant is financially dependent on the EU citizen;

• a document confirming legal residence in the territory of the Republic of Poland;

• a proof of having sufficient funds to cover the costs of residence without the need of using social welfare funds.

Issuing the residence card for a family member of the EU citizen is subject to a fee in the amount of 30 zlotys. The fee is payable to the bank account of the relevant province office where the application is submitted. The bank account number is provided on the website of the competent office. The application for issuing the residence card should be investigated within 6 months from the date of its submission.

Upon the receipt of the residence card, the foreigner must present a valid travel document or identity document and a confirmation of paying the fee in the amount of 30 zlotys. The receipt of the residence card need not be in person. The residence card can be collected by the foreigner’s proxy upon a presentation of a written power of attorney, together with the proof of having paid stamp duty on the power of attorney in the amount of 17 zlotys. Stamp duty on the power of attorney is payable to the bank account to the municipal office competent as for the place of submitting the power of attorney (bank account numbers are available on the websites of these offices). The power of attorney is not subject to the stamp duty when the proxy is a spouse, one of the parents, a grandparent, child, grandchild or the sibling of the foreigner.
The fact that the family member of the EU citizen has the residence card and a travel document or identity card entitles him to cross the Polish border without a visa.

The residence card is valid for 5 years. However, if the period of the intended residence in Poland of the EU citizen whom the family member joins or plans to join is less than 5 years, then the residence card is valid for the entire period of the intended residence of the EU citizen.
