The application for registering the EU citizen’s residence

The application for registering the EU citizen’s residence is submitted in the province office competent as for the place of residence of the EU citizen. For example, if a foreigner lives in Kraków, the application for registering the residence must be submitted in Małopolski Urząd Wojewódzki (the Małopolska Province Office).

The application shall be submitted in person, not later than the next business day after 3 months from the entry into the Polish territory. The application must be filed on the official form. The form shall be filled in Polish.

The application for registering the EU citizen’s residence must be attached with:

• a photocopy of the passport or other document certifying the identity and nationality of the foreigner;

• a confirmation of temporary registration in a given town.

In addition to the above documents, the applicant must attach further documents to the application in the following cases:

1) in the case when the EU citizen works in the territory of Poland, the application for registering the EU citizen’s residence must be additionally attached with:

• a written statement of the employer or the entity authorized to delegate work to the EU citizen on the intention to delegate work to him or a certificate of performing the work;

2) in the case of a self-employed person (conducting business activity) by the EU citizen in the territory of Poland, the following must also be attached:

• a proof that the business activity has been registered in the appropriate register (e.g. an extract from the register of entrepreneurs);

3) when one has health insurance and sufficient funds to cover the costs of residence without the need for using welfare benefits by the EU citizen, the application must be also attached with:

• a document constituting the evidence of having health insurance or entitlement to health care;

• a proof of sufficient funds to cover the costs of the residence without the necessity to use the means of social welfare in Poland; such evidence may be in particular:

○ a credit card;

○ a certificate of having funds in a bank or other financial institution, bearing the stamp and signature of an authorized employee of that bank or institution, issued at least one month before submitting the application for residence registration;

4) in the case of studying or carrying out vocational training by the EU citizen, the application shall be additionally attached with:

• a certificate of a state or non-state university that the foreigner has been admitted to the university or referred to vocational training;

• a proof of having health insurance or the entitlement to health care;

• a written statement that the foreigner has sufficient funds to support himself and his family members, without the need for welfare benefits, the proof of having such funds may be in particular:

○ a credit card;

○ a certificate of having funds in a bank or other financial institution, bearing the stamp and signature of an authorized employee of that bank or institution, issued at least one month before submitting the application for residence registration.

5) in the case of a marriage to a Polish citizen, the application must be additionally attached with:

• a current certified copy of the marriage certificate;

• a duplicate of the identity document of the spouse.

The registration of the EU citizen’s residence is subject to the fee in the amount of 1 zloty. The fee is payable to the bank account of the relevant province office where the application is submitted. The account number is provided on the website of the relevant province office.

The registration of the EU citizen’s residence shall take place immediately. After registering the residence, the foreigner receives the document in the form of a certificate of the EU citizen’s residence registration. Upon the receipt of the registration certificate, the foreigner must present a valid passport or identity document and a confirmation of paying the abovementioned fee. The receipt of the certificate need not be in person. The certificate can be collected by the foreigner’s proxy upon a presentation of a written power of attorney, together with the proof of having paid stamp duty on the power of attorney in the amount of 17 zlotys. Stamp duty on the power of attorney is payable to the bank account to the municipal office competent as for the place of submitting the power of attorney (bank account numbers are available on the websites of these offices). The power of attorney is not subject to the stamp duty when the proxy is a spouse, a parent, grandparent, child, grandchild or the sibling of the foreigner.
