An application for a residence permit for a long-term EC resident

An application for issuing a residence permit for a long-term resident of the European Communities is filed on the official form in the Polish language in the province office where the foreigner resides.

In the case when before the expiry of a legitimate period of the foreigner’s residence in the Polish territory there was no valid decision issued concerning a residence permit for a long-term EC resident, the competent authority (i.e. the province office) issues a national visa to the foreigner for a period of residence until issuing a decision on the said permit. After granting the permit, the national visa will be cancelled.

A foreigner cannot apply for a residence permit for a long-term EC resident if he resides abroad.

The application for a residence permit for a long-term EC resident shall be attached with the following:

• photographs;

• the documents necessary to confirm the data contained in the application and circumstances justifying the application for a residence permit for a long-term EC resident;

• the contract that proves the foreigner’s legal title to the dwelling premises in which the foreigner resides or intends to reside (e.g. tenancy contract, lending for use contract, if the lender is the foreigner’s child, grandchild, parent, grandparent, spouse, spouse’s parent or the foreigner’s sibling);

• the receipt of having paid a stamp duty

A stamp duty for granting a residence permit for a long-term EC resident amounts to 640 PLN. Whereas the fee for issuing the residence card – to 50 PLN (more on the residence card, see chapter Residence card). The stamp duty for a permit is payable in the cashier’s office of the competent municipal office or in the form of a bank transfer to the bank account of this office. In turn, the fee for issuing the residence card is payable to the bank account of the province office which issues this card.
