An application for a fixed-term domicile permit

An application for a fixed-term domicile permit is filed on the official form in the Polish language at the province office competent as for the place of the foreigner’s residence. The application must be filed at least 45 days before the expiry of the residence period under visa or the period for which the previous fixed-term domicile permit was granted. If the permit cannot be issued within this period, the foreigner will be granted a national visa for the duration of the ongoing proceedings in the case at issue. After granting a fixed-term domicile permit, the said visa will be cancelled.

However, if the foreigner fails to submit an application for a fixed-term domicile period within the period indicated above (i.e. at least 45 days before the expiry of the residence period under visa or the period for which the previous permit was granted) and the proceedings in this case will not have ended before the expiry of the said 45 days, the foreigner will be forced to leave the Polish territory and wait for the permit abroad. If the foreigner does not leave Poland and remains illegally there, then the decision will be issued to refuse a fixed-term domicile permit.

A foreigner may apply for a fixed-term domicile permit when he stays outside Polish borders, via the Polish consulate in a given country. In this case, the decision to grant the permit will be given in the same form, i.e. via the Polish consular office.

If the foreigner was forced to leave Poland and he waits abroad for the decision to grant him a fixed-term domicile permit, then in order to enter the Polish territory he should apply for a national visa in order to implement the fixed-term domicile permit (more on visas and their types, see chapter Visas). After entering the Polish territory under the said visa, the province office competent as for the foreigner’s place of residence will issue him a residence card confirming that the abovementioned permit has been granted (see: Residence card).

A fixed-term domicile permit is subject to a stamp duty amounting to 340 PLN. The fee is payable at the cashier’s office of the municipal office competent as for the city where the application is filed or in the form of a bank transfer to the bank account of this office.
