An application to issue a permit to acquire real estate by a foreigner

An application to issue a permit to acquire real property is not submitted in an official form. It is therefore necessary to prepare such an application oneself. An application to issue a permit to acquire real property should contain the following information:

  1. designation of the applicant (name and surname, nationality and address of residence);
  2. designation of the acquired real estate (number of the house, number of a flat, street, city, municipality and province, plot number, size of the plot in hectares or size of the premises in meters, the number of the land and mortgage book and the characteristics of the building development);
  3. designation of the vendor (name and surname or business name and place of residence or the address of the registered office);
  4. determination of the type of contract under which the acquisition of real property should take place (e.g. sale, donation, exchange);
  5. justification showing for what purposes the real property will be used.

The application must be attached with:

  1. certified copy or a duplicate of a document confirming the identity with the indication of the nationality, place of birth and address,
  2. issued not more than 6 months prior to the application: certified copy of the land and mortgage book, an extract from the land and property register, together with dimensioned drawing of the cadastral map and an extract from the current zoning plan, or in case of a lack of the latter – a document issued by the competent authority, certifying the lack of a plan or a decision on the location of investment for public purposes or zoning decision;
  3. a statement of the vendor expressing the intention of selling the real property to the foreigner;

In addition:

  1. if a foreigner relies on having Polish nationality or Polish origin – s/he should attach to the application the documents that prove these facts,
  2. if a foreigner refers to being married to a Polish citizen – s/he should attach to the application a copy of marriage certificate,
  3. if a foreigner refers to the possession of a residence permit for a fixed period, a settlement permit or a permit for long-term resident of the European Communities – s/he should provide the appropriate document (permit),
  4. if a foreigner relies on the membership in the governing body of the company – s/he should submit the following documents, issued not more three months prior to the application: a certified copy or an excerpt from the register of entrepreneurs of the National Court Register or a certificate from the register of business activity, a certificate from the competent tax office stating that an entrepreneur in which the foreigner serves as a director of managing body, is not in default of payment of taxes and a certificate from the competent branch of the Social Insurance Institution stating that an entrepreneur in which the foreigner serves as a director of managing body, is not in default of payment of social security fees,
  5. if a foreigner refers to the fact that s/he conducts economic or agricultural activity on the territory of Poland – s/he should attach the documents that would prove the performance of such activities, in particular, certified copies of licenses and permits obtained on Polish territory.

The application can be attached with duplicates of the above documents with a note on each duplicate that it is compatible with the original.
Foreign documents, drawn up in a foreign language should be submitted together with their translation into Polish language, certified by the Polish sworn translator (on how to obtain a translation of a sworn translator, see chapter Translation of foreign documents.

The application shall be sent to the following address:

or submitted in person at the Registry Office of Ministry of Internal Affairs and Administration – Rakowiecka 2a in Warsaw.

The application is subject to a stamp duty of 1,570 zlotys. The said amount shall be paid into the following bank account:
